Terms
These are the agreements between you and us when you use Racespot, as a runner or as a supporter. We've written them down as clearly as we can. By using Racespot you agree to them.
This is a translation of the Dutch terms. If the two differ, the Dutch version prevails.
Who we are
Racespot is a service of MARSSLOT, the sole proprietorship of Marcellino Sloterdijk, based in the Netherlands (Piet Soerstraat 35, 5703 GM Helmond, Chamber of Commerce number 84018445). Contact: info@racespot.app.
What Racespot is
With the Racespot app you share your position with your supporters during a running race. They follow you through a link in their browser, can share their spot along the route and record a cheer that you hear on the way. Racespot is not official timing: your official time is the one from the race organisation. Racespot is not affiliated with the races listed in the app, unless we explicitly say so. We only use race names and courses to help you pick your race. The date, start time and course in the race list may differ from what the organisation ends up doing: the organisation's information always comes first.
Your account
- To have an account you must be 16 or older, or have permission from a parent or guardian.
- Use correct details and keep your password to yourself. What happens with your account is your responsibility.
- You can always delete your account yourself in the app.
Safety during your race
Your own safety and that of others always comes first. Don't look at your phone while running when it isn't safe to do so, follow the rules of the organisation and watch your surroundings. Use your earbuds in a way that you can still hear announcers, emergency services and traffic. Racespot is not an emergency service: don't rely on it to call for help or to be found. Only take part in a race if your health allows it.
Sharing and cheering
- You decide who you share your link with. Anyone with the link can follow you during your race, so only share it with people you trust.
- As a supporter, you're responsible for what you record, and for the name and spot you share.
- By recording a cheer, you give us permission to store it and play it for the runner, and you give the runner permission to keep and share it, for example in a race story.
What's not allowed
- Following someone or sharing their position without that person knowing or wanting it.
- Offensive, threatening, discriminatory or otherwise unlawful cheers or names.
- Using Racespot to disrupt, abuse or copy the service, or to collect other people's data.
- Pretending to be someone else.
If you don't stick to this, we may remove content and limit or end your access. We don't check what supporters record in advance; we step in when we receive a report or notice something that isn't allowed. When we do, we tell you why, where we can.
Reporting something
Do you hear or see something in Racespot that isn't allowed, such as an offensive cheer, a name you don't want to see, or someone being followed without knowing it? Email info@racespot.app with the link to the race and what's going on. We'll look into it as soon as possible and let you know what we do with it. This address is also the point of contact for authorities and for questions about these terms; you can write to us in Dutch or English.
Pro and Race Pass
Racespot is completely free for now. Paid features (Pro per year, or a Race Pass for one race) will come later. As soon as you can buy them, the price and what you get are shown in the app before you pay, and the agreements below apply. You then buy them through your Apple ID in the App Store: Apple is the seller and handles payment, and Apple's terms also apply.
- Trial. Pro starts with a free week. If you don't cancel before the end of that week, the yearly subscription starts.
- Renewal and cancelling. The yearly subscription renews automatically until you cancel it. You cancel in your iPhone's settings (Subscriptions), at least 24 hours before renewal. You keep Pro until the end of the current period.
- Refunds and withdrawal. Refunds and the right of withdrawal go through Apple, under Apple's rules and your statutory consumer rights. Those rights always apply.
- Prices. We may change prices. For a running subscription you'll hear about it in advance, and the new price only applies from the next renewal.
Features marked as coming soon, such as an Apple Watch app or a Garmin data field, aren't available yet. We don't promise a date.
Availability and operation
We do our best to make Racespot work well, but we can't guarantee that it always works everywhere. Racespot depends on your phone, GPS, your mobile connection, your battery and services from others. In a busy start pen or in places with poor reception your position may be delayed or temporarily not visible, and a cheer may arrive late or not at all. We may change, improve or stop parts of Racespot.
Liability
We're not liable for damage caused by Racespot (temporarily) not working or working differently than expected, for example a missed cheer, an incorrect time or position, or a supporter you miss. Nor for what supporters record or share. If we are liable after all, this is limited to the amount you paid to Racespot in the twelve months before, with a minimum of €100. These limitations don't apply in case of intent or gross negligence on our part, nor to injury or death, and not to the extent the law doesn't allow them, such as your mandatory consumer rights.
Other services
Racespot works with services from others, such as the App Store, Strava and map services. Their own terms also apply to using them. For the iPhone app, Apple's standard Licensed Application End User License Agreement also applies; Apple is not a party to these terms and is not responsible for the app or its support. Strava, race names and other brands belong to their owners; Racespot is not affiliated with them.
Rights to Racespot
The app, the website, the design, the name and the logo of Racespot are ours. You may use Racespot for yourself, not copy or resell it. What you create, such as your races and cheers, stays yours; you only give us the right to use it as long as that's needed to make Racespot work.
Stopping
You can stop at any time by deleting your account. We may end your account if you seriously or repeatedly break these terms, or if we stop Racespot. If we stop Racespot, we'll let you know well in advance.
Changes
We may change these terms. We'll let you know about important changes in the app beforehand. If you keep using Racespot after that, the new terms apply. If you don't agree, you can stop.
Governing law
These terms are governed by Dutch law. If you have a complaint, please email us first: we're happy to find a solution together. If we can't work it out, you can go to the competent court in the Netherlands. If you live in another EU country, you keep the protection that the law of that country gives you as a consumer.
